Tenancy Agreement Consultation 2025/26

During 2025 City of Lincoln Council launched a review of its tenancy agreement which has been in use since 2015.  The reason for making the proposed changes included updating the tenancy agreement to bring it up to date with changes to legislation, making it easier to understand along with best practice to keep up to date with existing policies and procedures.

Preliminary Notice of Variation (Stage 1)

From August to September 2025, City of Lincoln Council launched a formal statutory consultation in accordance with section 103 of the Housing Act 1985 by writing to all tenants with a preliminary notice of variation and consultation pack. 

The statutory consultation process requires tenants to be consulted and communicated with as follows:

Preliminary Notice of Variation (Stage 1A - consultation & Stage 1B – Analysis of response to consultation) – A formal notice to all tenants detailing the proposed changes to the existing Tenancy Agreement and providing opportunity to feedback on the intended changes to the newly drafted Tenancy Agreement. 

As part of the consultation process a dedicated webpage and online survey was set up on the council's website to gather tenants’ views on the proposed changes.  Alongside the survey, a link to helpful documents was provided, this included the current tenancy agreement, proposed new tenancy agreement, proposed summary guide on the Tenancy Agreement, Frequently Asked Questions and documents detailing the proposed changes.   

The consultation was promoted via a variety of channels including tenant newsletters, social media, on email signatures and during telephone calls to customer services.  Within correspondence there was also an opportunity for tenants to contact directly with any queries via a dedicated email address (TenancyAgreementConsultation@lincoln.gov.uk) or by calling our customer services team. 

Face to face drop-in sessions were provided for tenants to attend.  This included venues within various wards available for all tenants to attend along with some Independent Living Schemes.

On 25th September 2025 the consultation survey closed and Stage 1A of the consultation concluded.

We would like to thank everyone who took part in the consultation on the proposed changes to the Tenancy Agreement. 

Analysis of feedback and findings from the consultation (Stage 1B) has taken place. 

The results, feedback and agreed changes were progressed through our committee approval process during January 2026 on the following dates:

  • 7th January 2026 – Housing Scrutiny Sub Committee
  • 20th January 2026 – Executive Committee

Notice of Variation (Stage 2)

As the updated Tenancy Agreement has been approved at Executive Committee, the Council is now proceeding to Stage 2 – Notice of Variation (Stage 2) as follows:

A formal notice of variation of the approved changes following consideration of feedback received during the consultation process will be sent to all secure tenants by 6th March 2026.   The Notice of variation includes a copy of the updated and final Tenancy Agreement wording being implemented. The new tenancy agreement will come into effect from 6th April 2026.  This notice of change has a minimum of 28 days notice to the tenant, so that if they are not happy with the intended changes they are able to give 4 weeks notice and end their tenancy.

For ease of reference a copy of the Stage 2 Variation letter being sent to all introductory and secure tenants will be uploaded soon along with a copy of the updated tenancy agreement.
