Coronavirus and Data Protection

City of Lincoln Council are keeping essential services running during the coronavirus outbreak and have set up new services to tackle this.

Resources are being prioritised and reallocated therefore requests for personal data or under Freedom of Information may be delayed.

Your personal data will remain protected as usual.

We hold personal data regarding residents, employees, partners and contractors. You may have provided your data for a specific purpose and normally we would inform you where your data is being used for another purpose.  Due to the fast changing situation this will not always be possible during the outbreak. 

We hold some data regarding vulnerability as defined by the Government and we may share this during the outbreak. For example relevant data in Revenues and Benefits, Council Tax, Community and Electoral Services. Only the minimal amount of data required will be shared and will be used only for the purpose of emergency planning or to assist, befriend and protect you and the public during this time. We may also receive limited vulnerability data about you from the Government or the NHS.

Your data may be shared internally with other departments at the council or externally with other public authorities, emergency services, partners and contractors acting on our behalf. Your data will only be shared where it is necessary, proportionate and will not be kept for longer than necessary.

We may also need to ask for your personal data including sensitive personal data. For example if you have any pre-existing medical conditions or if you are vulnerable due to your age that you have not supplied before.  This is so that we can assist and prioritise our essential services.

The purpose for which we use your personal data will determine the legal reason for its use.  These will usually be:

  • Where it is necessary for the performance of a task carried out in the public interest or under our duties and powers as a public authority Article 6.1(e) of the GDPR.
  • Where it is necessary to protect your vital interests or the interests of another person. Article 6.1(d) and 9.2(c).
  • Were it is necessary for the reasons of substantial public interest Article 9.2(g)
  • Where it is in the interest of public health Article 9.2(i).

Your data rights are not affected and you have the right to complain to the Information Commissioner’s Office (ICO). See section ‘where can I get advice’ for the ICO’s contact details and section ‘what are your legal rights relating to your data’.
